Jacob Baus, Staff Attorney, Office of Legislative Legal Services, testified before the Committee. Mr. Baus presented the Office's rule memorandum concerning the contested rule issue of the Colorado Uninsured Employers Board (Board) concerning the Colorado Uninsured Employers Fund.

Paul Tauriello, Director of the Division of Workers' Compensation (Division), Department of Labor and Employment (CDLE), and David Gallivan, Administrative Law Judge with the Division and Staff Liaison to the Board, testified before the Committee. Mr. Tauriello explained why the rule is within the Board's statutory authority. Mr. Gallivan talked about the plain language of the statute and how terms are defined and that the Board has the authority for the rule.

Representative Tipper and Mr. Gallivan talked about whether the Board hires experts and what type of attorneys the Board retains. Mr. Tauriello also talked about how there are unknowns on how things will work because this is a new program.
