Overview of Subpanel Policy Recommendations - Committee Discussion Only

Brian Rossbert, subpanel
chair, provided the subpanel policy recommendations based on the direction
of the task force at the last meeting.  He provided a handout (Attachment
A).  Cathy Alderman, subpanel vice chair, provided policy recommendations
where the subpanel came to consensus, including: short term rentals and
statewide homeless prevention and resolution.

Task force members made comments about the subpanel work.

Ms. Alderman summarized
the subpanel discussion related to short term rentals and the statewide
homelessness prevention and resolution.  She stated that the short
term rental discussion focused on property rights and use of properties,
including definitions of the property and commensurate tax rates.  She
mentioned there was also a discussion about local governments expending
tax dollars collected from these activities.

Ms. Alderman indicated that the subpanel talked about community solutions related to homelessness and the statewide goal related to homelessness.

Mr. Rossbert talked
about the policy recommendations where the subpanel did not reach consensus,
including: a study of state and local factors impacting development of
affordable housing; construction defect laws; land banking; and intergovernmental
agreements.

about the subpanel's conversation on construction defects and land banking.
 He indicated that the subpanel may have needed more time on these
subjects to reach consensus.  Mr. Rossbert also talked about the subpanel's
discussion surrounding the elimination of intergovernmental agreements.

asked about tap fees and municipal districts.  Mr. Rossbert stated
that those discussions occurred under the study subject.  The task
force member also asked about the difference between funding and policy
recommendations.  Mr. Rossbert indicated that, in some cases, the
policy recommendations came up after funding recommendations had been made.

A task force member asked about intergovernmental agreements. Mr. Rossbert indicated that some smaller communities do not have a housing authority to specifically engage in affordable housing activities. He stated that nonprofits in the community may be able to better address the issue in these communities.

Ms. Alderman provided
additional information about intergovernmental agreements, clarifying that
the proposal was not to eliminate agreements but to relax requirements.

about the terms "support" and "examine"  in the
policy recommendations and removing the word "support".

Motion Amend the consensus policy recommendation from the subpanel on short-term rentals: in the first bullet replace "have exacerbated" with "have affected" and strike the second sentence in the first bullet, "Furthermore, STRs have stretched community infrastructure beyond what was originally intended with residential developments."

Motion Approve the consensus policy recommendation from the subpanel on short term rentals as amended, including adding the word "and" between the word "mountain" and "resort" in the second line of the first bullet and removing the phrase "support and" in the beginning of the first line of the second bullet. The amendments also include modifications to the first bullet approved by the task force regarding the term exacerbated and the striking of the second sentence in the bullet.

A
motion was made to include the subpanel policy recommendation regarding
the study of state and local factors impacting the development of affordable
housing as a consensus recommendation in the final report. However, the
subpanel did not reach consensus on this policy.  The motion was withdrawn.

local control and House Bill 21-1271 incentives to communities.

Senator Bridges motioned
that the task force include in the charge for the standing committee, interim
committee, or task force on housing and homelessness the examination of
state and local laws, ordinances, regulations, permitting practices, and
fees that contribute to or impact the development of affordable housing.
 The motion died for lack of a second.

Representative Roberts summarized task force approvals, including funding recommendations and discussions with the Governor's office. He thanked the subpanel for their work.
