Majority Leader Duran,
Chair, called the meeting to order and reviewed the meeting agenda  (Attachment
A). A packet of the following bill drafts and associated fiscal notes were
distributed to the committee:




- Bill Draft 1, addressing the American Indian Affairs Interim Committee
(Attachments B and C);


- Bill Draft 2,
addressing federally recognized Tribes and the construction of laws (Attachments
D and E);


- Bill Draft 3,
addressing protecting wild bison (Attachments F and G);


- Bill Draft 4,
addressing cultural competency continuing education requirements (Attachment
H and I); and


- Bill Draft 5,
addressing the recognition of tribal court orders (Attachment J and K).


- Bill Draft 6,
addressing the comprehensive history of Tribal Nations to be taught in
public schools, was withdrawn prior to finalization and not considered
for futher action by the committee.



Office of the Liaison for Missing and Murdered Indigenous Relatives Presentation - Committee Discussion Only

Melody Delmar and
Dr. Matt Lunn, representing the Department of Public Safety, presented
to the committee (Attachment L). Dr. Lunn reviewed information about the
Office of the Liaison for Missing and Murdered Indigenous Relatives (OMMIR).
He discussed the national search for the OMMIR director and how community
members and advocates were involved in the process.

Ms. Delmar reviewed
information about Missing and Murdered Indigenous Relatives (MMIR) and
the history of the movement. She discussed the importance of building community
partnerships to look at how the state can best respond to MMIR cases and
how to connect families to state and community resources when a family
member is missing or murdered. Ms. Delmar discussed how law enforcement
has been involved in community events organized by the OMMIR.

Ms. Delmar continued
her presentation, further discussing the partnerships being developed by
the OMMIR and how certain staff positions are being filled to address the
data and research needs of the office.

Ms. Delmar and Dr.
Lunn responded to questions from the committee. In response to questions,
Ms. Delmar discussed the work she has done with other states and federal
partners, how MMIR is a borderless issue, and the jurisdictional issues
that might arise in an MMIR case.

Attorney General
Phil Weiser, representing the Department of Law, presented to the committee.
He discussed how his office has worked with Colorado's federally recognized
Tribes on a range of issues, including water matters, opioids, and law
enforcement. Attorney General Weiser explained how a portion of the state's
opioid settlement was designated to the Tribes. He commented on the draft
legislation being considered by the committee, specifically Bill Draft
2, concerning federally recognized Tribes and the construction of laws.

Attorney General Weiser responded to questions from the committee. Specifically, he responded to questions concerning MMIR issues.

Majority Leader Duran
presented Bill Draft 1 - American Indian Affairs Interim Committee. The
bill creates the American Indian Affairs Interim Committee as a permanent
interim committee through the 2029 legislative interim. Committee members
commented on the bill.

Senator Simpson presented
Bill Draft 2 - Federally Recognized Tribes and Construction of Laws. The
bill clarifies which laws passed by the General Assembly do and do not
apply to the Southern Ute Indian Tribe.

Alana Rosen, representing the Office of Legislative Legal Services, responded to committee questions about Bill Draft 2.

Senator Danielson
presented Bill Draft 3 - Protect Wild Bison. The bill classifies bison
as big game wildlife unless the bison is livestock, and makes it illegal
to hunt bison unless authorized by the state.

Representative Joseph
presented Bill Draft 4 - Cultural Competency Continuing Education Requirements.
The bill requires continuing medical education requirements to include
one credit hour on American Indian cultural competency as determined by
a stakeholder process.

Senator Roberts presented
Bill Draft 5 - Recognition of Tribal Court Orders. The bill requires state
courts, law enforcement, hospitals, behavioral health facilities, and health
care providers to recognize and enforce tribal court orders, including
arrest warrants and behavioral health commitment orders. Senator Roberts
referenced an amendment he would be offering later in the meeting.

- Chairman Melvin
Baker, representing the Southern Ute Indian Tribe, spoke on the five bill
drafts being considered by the committee, as well as other legislative
matters; and




-Teddy McCullough,
representing himself, spoke on a variety of issues related to the committee,
including Bill Draft 4 - Cultural Competency Continuing Education Requirement.

- Dr. Abigail
Urish, representing the Colorado Academy of Family Physicians, spoke on
Bill Draft 4 - Cultural Competency Continuing Education Requirement; and





- Dr. Brigitta
Robinson, representing the Colorado Medical Society, spoke on Bill Draft
4 - Cultural Competency Continuing Education Requirement.
