Senator Baumgardner, prime sponsor, presented House Bill 16-1186. Under current law, 3 percent of public utilities fees collected by the Department of Revenue (DOR) on behalf of the Public Utilities Commission (PUC) in the Department of Regulatory Agencies (DORA) must be credited to the General Fund. The reengrossed bill requires that up to $150,000 of the fees be diverted to the Fixed Utility Fund (FUF) with any remainder credited to the General Fund. This diversion will occur in FY 2016-17 and any fiscal year thereafter in which a grant match is required for the receipt of federal money under the federal Moving Ahead for Progress in the 21st (MAP-21) Century Act for rail fixed guideway system safety oversight responsibilities.

Senator Baumgardner, co-prime sponsor, presented House Bill 16-1211 and amendment L.007 (Attachment A). The reengrossed bill creates state medical and retail marijuana transporter (marijuana transporter) licenses to be issued by the Marijuana Enforcement Division (MED) in the Department of Revenue (DOR), and allows for the issuance of a local medical marijuana transporter license. A marijuana transporter provides logistics, distribution, and storage of medical and retail marijuana and marijuana-infused products, but is not authorized to sell marijuana under any circumstances. All marijuana transporters must be licensed by July 1, 2017, with the exception of a marijuana transporter for a medical marijuana business or retail marijuana establishment that provides its own distribution. The MED must begin accepting applications by January 1, 2017.

State marijuana transporter licenses are valid for three years and cannot be transferred with a change of ownership. Marijuana transporters may operate a licensed off-premises storage facility that meets the same security requirements as a medical marijuana optional premise cultivation license or a retail marijuana cultivation license as long as it is located in a jurisdiction that allows its operation.



Marijuana transporters are required to use the MED seed-to-sale tracking system to create shipping manifests documenting the transport of medical and retail marijuana and marijuana-infused products throughout the state. A marijuana transporter is responsible for all medical and retail marijuana and marijuana-infused products once it takes control of the product. Marijuana transporters may contract with multiple medical and retail marijuana licensees.

The committee returned to order. Senator Kefalas, prime sponsor, presented House Bill 16-1319. The reengrossed bill prohibits the visual exhibition of smoke, often referred to as "coal rolling," which is defined in the bill as the knowing release of high quantities of emissions from an exhaust system in a light-duty diesel vehicle into the air and onto roadways in order to harass another vehicle, bicyclist, or pedestrian, or to obstruct or obscure the view of another driver, roadway user, or a traffic control device. Under the bill, visual exhibition of smoke is a class A traffic infraction punishable by a fine of $35 and 2 points assessed against the violator's driving record for each offense.
