Senators Scott and Gardner explained SB18-258, concerning excluding from the speedy trial calculation the period of delay caused by a continuance ordered by the court.  The senators explained the merits and practicality of the bill.  They answered questions from the committee about the rights of the accused and exceptions to speedy trials. 

Lucienne Ohanion, representing the Office of the Colorado State Public Defender, spoke in opposition to the bill.  She brought up constitutional rights and due process.  

Dan Rubenstein, District Attorney for Mesa County, spoke in support of the bill.  He explained the differences between the Colorado statutory right to a speedy trial and the constitutional right to one.  He also discussed timelines, limitations, and the circumstances under which a defendant may be granted a continuance. 

Dan May, District Attorney for El Paso County, testified in support of the bill.  He discussed the "gamesmanship" involved with Colorado's speedy trial statutory scheme.
