Senator Moreno, bill sponsor, explained House Bill 21-1108, concerning updates to prohibitions against gender-based discrimination to clarify the individuals who are included in a protected class.  He discussed gender expression, gender identity, and sexual orientation, and extending protections.

Michael Tschampl, representing self, testified in opposition to the bill. He discussed the First Amendment.

 

Mrs Michele Markham, representing self, testified in opposition to the bill. She raised concerns about safety, privacy, and violation of her First Amendment rights. 

Mr. Jeff Hunt, representing The Centennial Institute, testified in opposition to the bill.  He discussed religious discrimination.

 

Mr. Joseph Feiten, representing self, testified to amend the bill.  He discussed ways to clarify terminology and other suggestions. 

 

 

Robert McDonough, representing self, testified in opposition to the bill.  He discussed athletic competitions and incarceration.

 

Brittany Vessely, representing Colorado Catholic Conference, testified in opposition to the bill. She raised concerns that the bill codifies discrimination against other beliefs.

 

The committee asked questions about religious expression.

Ms. Rachel Clark, representing Colorado Women's Bar Association, testified in support of the bill.  She discussed current laws and updating terminology.

 

Ms. Iris Halpern, representing Rathod Mohamedbhai LLC, testified in support of the bill. She addressed stereotypes and applicable laws.  Shs answered questions from the committee about gender expression and subjectiveness. 

 

The committee discussed religion and subjectivity. 

 

 

Mr. Clayton Wire, representing Colorado Plaintiffs Employment Lawyers Association (PELA), testified in support of the bill.  He discussed the Colorado Anti-Discrimination Act and protected classes.

Senator Gardner explained and distributed Amendment  L. 021 (Attachment B), which addresses concerns from religions organizations.

 

The bill sponsor expressed concerns that the amendment would open the door for discrimination. 

 

The committee discussed hospitals and schools operated by religious organizations.
