The committee was called to order. A quorum was present. Representatives Thurlow and Arndt, prime sponsors, explained HB18-1143, concerning the repeal of statutory provisions relating to sexually explicit materials harmful to children that were ruled unconstitutional by the Colorado Supreme Court.
Amendment L. 001 (Attachment A) was distributed to make a technical change in the bill.
Committee discussion followed regarding the purview of the Statutory Revision Committee. Questions were also raised about why these provisions need to be removed from the statutes instead of remaining with case law references.
Jane Ritter, Office of Legislative Legal Services, answered questions from the committee about head notes, editor notes, and annotations. Severability issues were also discussed.
Representatives Thurlow and Arndt made closing remarks.
