Senators Ball and
Gonzales, bill sponsors, presented Senate Bill-190, concerning processes
for offender release from custody. The bill allows a defendant released
on bail to stay overnight in jail to facilitate a connection to a service
provider, and makes changes to special needs parole within the Department
of Corrections.




The bill sponsors
distributed Amendments L.001 and L.002 (Attachments C and D).




Committee members
asked questions about special needs parole and reasons for its infrequent
use. Further discussion ensued about qualifications and exempted crimes
that apply to special needs parole.

Spero Justice Center, testified in support of the bill. Dr. Kim Cullen,
representing themself, testified in support of the bill. Jack Johnson,
representing Disability Law Colorado, testified in support of the bill.
Jill Allen, representing Office of the Colorado State Public Defender,
testified in support of the bill.




Committee members
asked questions about qualified health care provider definitions, health
care inside facilities, and options for these parolees to receive care
in the community.  The age differentiations as outlined in the bill
were also discussed, along with crime exclusions.
