Representatives Melton and Benavidez, co-prime
sponsors, introduced House Bill 20-1233, concerning constitutional protections
for conducting basic life functions in public spaces. The bill prohibits
the state and any city, county, city and county, municipality, or other
government entity from restricting a person to conduct basic life functions
in public space unless the government can offer alternative adequate shelter
and a person denies the shelter. A person may occupy a motor vehicle,
as long as the vehicle is legally parked on public property or parked on
private property with the permission of the property owner.
