Representatives Willett and Foote, prime sponsors, presented House Bill 18-1066, concerning clarifying that the law enforcement and defense counsel exemption for sexual exploitation of a child crime does not change the discovery procedures for sexually exploitative material. Representative Foote explained the effect of the bill and discussed its need. The following persons testified regarding HB 18-1066:
Mr. John Camper, representing the Department of Public Safety, Mr. Tim Lane, representing the Colorado District Attorneys' Council, and Ms. Maureen Cain, representing the Office of the State Public Defender, testified in support of the bill. Mr. Camper provided background on the effect of Senate Bill 17-115, and explained how HB 18-1066 improves some ambiguous language in SB 17-115. Ms. Cain explained how the language in SB 17-115 led to confusion in the discovery process. Mr. Lane provided additional input.
