Representative Ginal presented Senate Bill 17-249 to the committee, along with amendment L.004 (Attachment A), amendment L.005 (Attachment B), and two handouts (Attachments C and D). This bill continues the Division of Insurance in the Department of Regulatory Agencies (DORA) until September 1, 2030, and implements recommendations from the 2016 sunset report. The bill establishes a separate sunset date of September 1, 2022, for the regulation of preneed funeral contracts. The division is required to study whether preneed funeral contract sellers are in compliance with applicable law and determine strategies to gain compliance if sellers are not in compliance. The division will report their findings by September 1, 2017, to the House and Senate Business committees. In addition to various technical changes, the bill:

• repeals the duties assigned to the Department of Public Health and Environment related to health maintenance organizations (HMOs) and reassigns them to the Commissioner of Insurance;
• repeals the Certified Capital Company Act effective July 1, 2025; and
• repeals the exemption from consumer protection statutes for private passenger automobile policies with more than four automobiles.

Representative Ginal presented Senate Bill 17-278 to the committee, along with a handout (Attachment E). The bill prohibits the nuisance exhibition of motor vehicle exhaust, which is the knowing release of soot, smoke, or other particulate emissions, from a motor vehicle with a gross vehicle weight rating of 14,000 pounds or less. If the exhaust obstructs or obscures another person's view of the roadway, other users of the roadway, a traffic control device, or otherwise creates a hazard to a driver, bicyclist, or pedestrian, it is a class A traffic infraction, punishable by a fine of $100 and a surcharge of $10. All vehicles used for commercial activities are exempt from the bill.

The bill requires the Department of Health Care Policy and Financing (HCPF), in collaboration with the Department of Human Services (DHS), to prepare a written report for various committees in the General Assembly concerning the feasibility of providing residential and inpatient substance use disorder treatment as a part of the Medicaid program. This report will include information related to the treatment of substance abuse disorders and the costs associated with providing treatment through Medicaid. Additionally, the report will issue recommendations concerning a time frame for implementing substance use disorder treatment as a benefit under Medicaid, effective use of state and federal funding, and changes to state law necessary to implement this treatment as a part of Medicaid. The report is due no later than November 1, 2017.

The bill allows a pharmacist filling a prescription for a schedule II opioid to dispense the drug in smaller increments when the partial fill is requested by the patient or practitioner who wrote the prescription and the total amount dispensed through incremental fillings does not exceed the total quantity prescribed. The bill sets forth timing, documentation, and prescribing practitioner notification requirements concerning partial fillings of opioid prescriptions.

Under the bill, a patient who receives a partial opioid prescription is not subject to any cost sharing or coinsurance under his or her's health plan for subsequent fills of the remaining portion of the prescription after paying for the initial portion.
