Representative Liston, prime sponsor, presented House Bill 17-1083, concerning an exemption for certain traffic violations of the requirement that a municipal judge inform a defendant of certain rights. Representative Liston explained the effect of the bill and discussed its need. Representative Liston responded to questions regarding the position of certain entities on the bill. The following persons testified regarding the bill:
02:05 PM -- Mr. Robert Frick and Mr. Hayden Kane, representing Municipal Court Judges, testified in support of the bill. Mr. Frick explained the purpose of the bill. Mr. Kane provided clarification regarding the effect of the bill, and recently adopted legislation concerning traffic infractions. Discussion ensued regarding the types of advisements that would not be provided by judges if HB 17-1083 were to pass. Mr. Frick responded to questions regarding the effect of HB 16-1309, and how HB 17-1083 augments that earlier legislation. Discussion followed regarding the types of penalties that are levied for the traffic infractions covered by the bill, and the number of persons that would be affected by the bill. Mr. Frick and Mr. Kane responded to questions regarding the effect of the bill on the use of mail-in pleas for traffic infractions.
