Representative Nordberg, bill sponsor, presented Senate Bill 17-028 to the committee. The reengrossed bill requires the Colorado Department of Human Services (DHS) and county departments of human services to:



• collect information concerning the military affiliation of any person who has custody or control of a child who is the subject of an investigation of child abuse or neglect; and

• provide the command authority of a military installation with notice of, and information about, reports of known or suspected child abuse that are assigned for assessment concerning a member of the armed forces assigned to that military installation or the spouse, significant other, or other family member who resides with that service member.



The DHS and county department may enter into memoranda of understanding with the command authority of military installations to establish protocols for information sharing and for collaboration on the oversight of child welfare investigations involving military personnel and their family members. The military installation shall only use information shared about an investigation for its intended purpose and must maintain confidentiality of the information. The State Board of Human Services must promulgate rules for implementation of this bill. Representative Nordberg responded to questions from the committee.

Representative Hamner and Representative Willet, bill sponsors, presented Senate Bill 17-126 to the committee and distributed amendment L.007 (Attachment A). The reengrossed bill creates the Colorado Domestic Violence Fatality Review Board (board) in the Department of Law. The board is to be chaired by a designee of the Attorney General and shall include between 17 and 20 other members appointed by October 1, 2017. Members include representatives from the forensic, domestic violence, law enforcement, prosecutor, and judicial communities. Members serve without compensation, but may receive per diem and reimbursement for costs, subject to the availability of funds. The board is repealed as of September 1, 2022. The board is to convene its first meeting no later than November 1, 2017, and is charged with:

• examining data collected by review teams during the preceding year;

• identifying measures to help prevent domestic violence fatalities and near-death incidents;

• establishing uniform methods for collecting, analyzing, and storing data relating to domestic violence fatalities and near-death incidents; and

• making annual reports and policy recommendations concerning domestic violence to the General Assembly on or before December 1, 2018, and each December 1 thereafter.

    Representative Young, bill sponsor, presented House Bill 17-1343 to the committee and distributed two handouts (Attachments D and E). This bill, recommended by the Joint Budget Committee, implements conflict-free case management for people with intellectual and developmental disabilities who are enrolled in a Medicaid home- and community-based services (HCBS) waiver program. As defined in the bill, conflict-free case management refers to case management services provided by a case management agency that is a different agency from the one that provides services and supports to a client. Case management agencies must develop individualized plans for people enrolled in the HCBS waiver program. The state Medical Services Board must promulgate rules pertaining to the certification of case management agencies and the process by which people can select the case management agency of their choice.

    No later than July 1, 2018, the Department of Health Care Policy and Financing (HCPF) must determine the options for community-centered boards to become compliant with conflict-free case management. The bill further outlines a timeline for community-centered boards to alter their business plans and attain compliance with conflict-free case management. No later than June 30, 2022, all clients receiving HCBS must be served through a system of conflict-free case management. Under this bill, HCPF is authorized to seek a federal exemption from conflict-free case management requirements for geographic areas where the only entity willing to provide case management services is also the only entity capable of providing HCBS in that area.

    Representative Young, bill sponsor, presented House Bill 17-1353 to the committee and distributed two handouts (Attachments F and G). The bill, recommended by the Joint Budget Committee, provides a statutory framework and sets forth requirements for the existing Accountable Care Collaborative (ACC) for the Medicaid program in the Department of Health Care Policy and Financing (HCPF) and authorizes performance payments to Medicaid providers. Specifically, the bill requires that the ACC:

    • establish primary care medical homes for Medicaid clients within the ACC;

    • provide regional care coordination and provider network support;

    • provide data to regional entities and providers to help manage client care;

    • integrate the delivery of behavioral health and physical health services;

    • connect primary care with specialty care and nonhealth community supports;

    • promote client choice and engagement;

    • utilize innovative care models and provider payment models as part of the care delivery system, including capitated managed care models;

    • receive feedback from stakeholder groups;

    • establish a flexible structure for the ACC that allows for efficient operations and future expansion to include long-term care and supports; and

    • establish a care delivery system and provider payment platform that can adapt to changes in federal funding models or funding levels.



    In addition, the bill requires HCPF to report to the Joint Budget Committee and the Health and Human Services Committees of the General Assembly by December 1, 2017, and each December 1 thereafter, about the ACC, including the number of clients served, performance results and health impacts, administrative fees and program costs, fiscal performance, activities in rural and frontier counties, waste reduction, and various other aspects of the ACC. The first report must also list additional statutory changes needed to align the statewide managed care system with federal regulations on managed care.
