Representative Gray introduced Senate Bill 19-090 concerning the operation of peer-to-peer motor vehicle sharing business. The bill regulates peer-to-peer car sharing, including requiring that the car be insured by the owner, driver, or program and that the insurance that satisfies the required coverage is the primary insurance; requiring that the car sharing programs notify the car owner that sharing the car may violate any lien on the car; authorizing the shared car owner's insurer to exclude coverage when the car in the program gives the insurer a right of contribution for any claims made as a result of car sharing; prohibiting an insurer from denying coverage outside of sharing solely because the car covered on the policy has been made available for sharing unless the car owner fails to provide complete and accurate information; setting recordkeeping requirements; clarifying that the car sharing program and shared car owner are exempt under federal law from vicarious liability based on ownership of the car; authorizing a car sharing program to be the named insured for a shared car; requiring the program to make certain disclosures and provide an emergency telephone number; requiring the program to verify a driver's license and keep records of the verification; making the program responsible for equipment installed on the shared car for sharing purposes; and, when there is a safety recall, requiring the program and the car owner to remove the car from the program until repaired.

Representative Benavidez introduced HB19-1124 concerning protecting Colorado's right to be free from certain federal mandates. The bill prohibits a department, agency, board, commission, or officer or employee of the state or a political subdivision of the state from using public funds or resources to assist in the enforcement of federal civil immigration laws. A state employee or employee of a political subdivision may assist federal immigration authorities in the execution of a warrant issued by a federal judge or magistrate or honoring any writ issued by any state or federal judge concerning the transfer of a prisoner to or from federal custody. The state or a political subdivision of the state may not enter into any contractual agreement that would require an employee to directly or indirectly assist in the enforcement of federal immigration laws. Federal immigration authorities are prohibited from accessing secure areas of any city or county jail or other law enforcement facility in conducting investigative interviews or other purposes related to enforcing federal civil immigration laws, unless federal immigration authorities present a warrant issued by a federal judge or magistrate. Law enforcement officers are prohibited from arresting or detaining an individual solely on a civil immigration detainer. The sponsor and chair of the committee suggested that the bill be referred to the House State, Veterans and Military Affairs Committee.
