HB18-1183 - Referred to the Committee of the Whole - Consent Calendar

Senator Baumgardner, prime sponsor, discussed
the provisions of House Bill 18-1183 concerning the sunset repeal of the
Department of Agriculture's regulation of home sale of meat.  As recommended
by the Department of Regulatory Agencies 2017 sunset review, the reengrossed
bill repeals the Sale of Meat Act under which the Department of Agriculture
regulates home food service plans.  Under current law, the department
will have 12 months to wind down the regulatory program.  The bill
removes the program from statute.

Services Division in the Colorado Department of Agriculture, spoke in support
of the bill and explained why the program is no longer needed.

of Agriculture's regulation of home sale of meat and offered to answer
any questions from the committee regarding that report.

HB18-1051 - Referred to the Committee of the Whole - Consent Calendar

Senator Coram and Senator Merrifield, co-prime
sponsors, discussed the provisions of House Bill 18-1051 concerning statutory
provisions for unattended fires.  Under current law, the penalty for
leaving a campfire unattended or failing to extinguish a campfire is a
class 2 petty offense punishable by a fine of $50.  The reengrossed
bill specifies that anyone who knowingly or recklessly fails to attend
to a campfire or fails to thoroughly extinguish a campfire before leaving
the site commits the offense of leaving a campfire unattended.  For
a person who leaves a campfire unattended in a forested or grassland area,
or on Colorado Parks and Wildlife land (CPW), the bill changes the penalty
to a class 3 misdemeanor, punishable by a minimum $50 fine and a maximum
of six months in jail, or a $750 fine, or both.  In addition, the
bill removes the requirement that counties post certain notices related
to unattended campfires. The bill applies to offenses committed on or after
July 1, 2018.

of the bill.  He also responded to questions from the committee about
the bill.

 spoke in support of the bill and announced that the Colorado Municipal
League also supports the bill.  He also distributed a fact sheet on
the bill [Attachment E] and responded to questions from the committee about
the bill as amended in the House of Representatives.

Dianna Orf, Associated Governments of Northwest Colorado, spoke in support of the bill.

Carrie Thompson, Colorado Criminal Defense
Bar, responded to questions from the committee about the amendments to
the bill that were adopted by the House of Representatives.  She also
discussed the levels of penalties for arson that are specified in Colorado
statute.

inadvertently leaving it paused following a recess).

HB18-1073 - Referred to the Committee of the Whole - Consent Calendar

Senator Gardner, prime sponsor, discussed
the provisions of House Bill18-1073 concerning the ability of water districts
to contract water assets.  Under current law, a water conservancy
district may contract to sell, lease, or otherwise dispose of the use of
its water to public corporations, persons, mutual ditch companies, water
users' associations, and other private corporations for irrigation, domestic,
or commercial use.  This reengrossed bill allows a water conservancy
district to also contract to sell, lease, or otherwise dispose of capacity
in works (facilities) and expands the allowable recipients to include districts
and utilities, and the uses of water and works to include municipal, industrial
and other authorized uses.  It also allows a water district or its
water activity enterprise to contract with any other person, including
a district or a water activity enterprise of another district for the use
of water or a water project or facility.

Bennett Raley, Northern Colorado Water
Conservancy District, spoke in support of the bill and announced that the
Colorado Water Congress supports the bill.  He also discussed financing
for the Windy Gap Firming Project.  Mr. Raley responded to questions
from the committee about the bill's effect on municipal water providers.

Dee Wisor, Northern Colorado Water Conservancy District, spoke in support of the bill and discussed the bond financing process.
