Senator Scott presented Senate Bill 17-301, which annually transfers $2.1 million to the Colorado Energy Office in the Office of the Governor from the General Fund for four years from FY 2017-18 through FY 2020-21. It increases annual registration fees for plug-in electric vehicles by $35 per vehicle, to be deposited into the Highway Users Tax Fund. It requires the Colorado Public Utilities Commission to adopt rules related to investor-owned utility interests in Colorado-based natural gas reserves. It requires the CEO and the Department of Natural Resources to form a stakeholder group to address funding shortfalls related to abandoned oil and gas wells. It also repeals several defunct energy-related statutes in the CEO. Finally, the bill makes changes to the Property Assessed Clean Energy program. Senator Scott discussed amendment L.022 (Attachment A).

Under current law, a county can propose a county public safety improvement tax by passing a resolution to submit a ballot question to the voters at the next general election. General elections are held in even-numbered years. Grants must be awarded by April 1, 2018. The bill moves the last date by which the grant review committee must submit an annual report to the Governor and the General Assembly from May 1, 2019, to May 1, 2020. Senators Williams and Priola, co-prime sponsors, presented House Bill 17-1043. Under current law, the Department of Public Safety must report on the activities of the Colorado Fraud Investigators Unit as part of its State Measurement, Responsive, and Transparent Government Act (SMART Act) hearing every year through 2017. This bill extends this SMART Act hearing requirement through 2018. Additionally, the unit is partially funded through a surcharge on uniform commercial code filings. In 2014, this surcharge was increased from $3 to $4 and is scheduled to revert back to $3 on June 30, 2017. This bill extends the $4 surcharge to June 30, 2018. Senators Priola and Fenberg, co-prime sponsors, presented House Bill 17-1227. To promote demand-side management, the Colorado Public Utilities Commission was required in 2007 to establish goals for Colorado investor-owned electric utilities to achieve by 2018 a 5 percent reduction relative to 2006 levels in the utility's retail system peak demand, measured in megawatts; and retail energy sales, measured in megawatt-hours. This bill extends these demand-side management programs to 2028. The bill also requires the PUC to set new goals for demand-side management programs implemented between 2019 and 2028 of a 5 percent reduction in peak demand and energy sales relative to 2018 levels. The PUC has the discretion to establish interim goals or revise goals. Senators Priola and Fenberg responded to committee questions. Senators Priola and Kefalas, co-prime sponsors, presented House Bill 17-1354, which modifies procedures for county treasurers to collect delinquent taxes on mobile homes, including manufactured homes, that are not affixed to the ground. Under current law, county treasurers must enforce collection of delinquent taxes on mobile homes through a court action or by seizing and selling the mobile home. The bill gives discretion to county treasurers to determine how to collect delinquent taxes on mobile homes. In addition, the bill authorizes a county treasurer to declare tax liens for mobile homes as county-held, and to withhold tax liens for mobile homes from being sold to investors.
