Senators Hill and Kerr, co-sponsors, presented House Bill 17-1151. The bill removes electrical assisted bicycles from the definition of motor vehicle and defines an electrical assisted bicycle as a bicycle equipped with an electric motor not exceeding 750 watts of power. This bill creates three classes of electrical assisted bicycles. Every manufacturer or distributor of new electrical assisted bicycles is required to attach a label that contains the classification number, as shown in Table 1. A person is prohibited from modifying an electrical assisted bicycle without replacing the classification label. Electrical assisted bicycles must comply with the equipment and manufacturing requirements for bicycles adopted by the Consumer Product Safety Commission. Anyone who violates the labeling and equipment provisions is subject to a Class B traffic infraction, with a fine of $15 and a surcharge of $6. Local authorities may prohibit the operation of Class 1 or Class 2 electrical assisted bicycles on a bike or pedestrian path under it's jurisdiction.

Senator Hill indicated his intention to work with stakeholders to draft an amendment to address Mr. McNeil's concerns. Senator Baumgardner announced that the bill would be laid over for action only. The committee took a brief recess.
02:59 PM -- HB17-1107
The committee returned to order. Senator Martinez Humenik, prime sponsor, presented House Bill 17-1107. The reengrossed bill primarily modifies state law to replace the term "Colorado State Titling and Registration System (CSTARS)" with the term "Driver License, Record, Identification, and Vehicle Enterprise Solution (DRIVES)" and creates two revenue transfers from the CSTARS account to the newly created Colorado DRIVES Vehicle Services account as follows:
- • 33 percent of the CSTARS account fund balance to the DRIVES account on September 1, 2018; and
• the remainder of the CSTARS account fund balance to the DRIVES account on June 30, 2019.
In addition, the bill:
- • replaces the CSTARS Advisory Committee, which is currently composed of seven county clerks, with the DRIVES County Governance Committee, composed of nine total members including six county clerks, two Department of Revenue (DOR) employees, and one Office of Information Technology (OIT) employee, who approve DRIVES' annual operating budget and may establish subcommittees and working groups to report to the committee;
• authorizes the Division of Motor Vehicles (DMV) to share images with driver license agencies in other states;clarifies responsibility for title and registration documents between county clerks and DOR;
• codifies in law the practice whereby county clerks transfer motor vehicle transaction revenue electronically to the DMV;
• aligns the terms "authorized agent" and "county clerk" to be synonymous, and redefines last know address for notifications regarding driving privileges; and
• redirects CSTARS account revenue to the DRIVES account as of September 1, 2018.
